Budding business in Boulder Creek

Boulder Creek Collective owner Marc Whitehill is creating a storefront where local cannabis growers can make a living by serving the medical needs of the community.

“There are a lot of marijuana growers in Boulder Creek. Right now, most of that money goes into the black market. But this collective can make all that money clean, which is a benefit to the entire community,” said Whitehill, 47, who opened the medicinal marijuana dispensary in December.

California’s illegal marijuana market is about $14 billion annually, according to statistics from a recent state senate bill.

Whitehill argued that people who grow marijuana for legal use should have tax advantages and be treated like any other business.

“They won’t have to hide from authorities, and this money now can come out clean and get taxed,” Whitehill said. “So, basically, all of a sudden your neighbor — and it is your neighbor — who was a criminal all of a sudden gets decriminalized. And you would be shocked at some of our growers — nice, 50-year-old, middle-class-looking women that you think are home watching soap operas, bringing in the most amazing marijuana.”

The former registered nurse-turned-entrepreneur quietly opened The Boulder Creek Collective last year, offering a range of marijuana-based topical creams, cannabis edibles and plants.

“We didn’t want to shock or surprise people,” Whitehill said. “We thought if we went slow and quietly, people would take the time to see what we’re doing and how we’re doing it.”

Whitehill said the business promotes itself by offering top-grade products for reasonable prices and a caring staff.

“We serve about 130 to 150 patients with an average age range of mid-to-late-40s,” Whitehill said.

He touts the dispensary as a true collective — not a pot shop that’s all about profit. Local growers provide the marijuana he sells.

But the dispensary has taken some heat for its proximity to a playground and the Boulder Creek Recreation Center.

“There were some complaints by some moms, because it’s so close to where kids play, but we haven’t had any big problems. The business seems legitimate,” said Christina Horvat, manager of the Boulder Creek Recreation and Park District.

There is no signage outside the dispensary, and Whitehill said marijuana is not ingested on the premises.

Whitehill said debate about whether his collective should exist or medical marijuana should be allowed shouldn’t be up for argument.

“The law in California is that people have the right to medical marijuana,” he said. “So, whether you agree or disagree with it, it’s the law.

The use of marijuana for medical purposes has been legal in California since 1996, when voters approved Proposition 215. Last year, President Obama instructed federal law enforcers to lay off medical marijuana users and suppliers, as long as they adhere to state laws.

Still, while medicinal marijuana is legal in California, the details of how and where it can be exchanged are murky. A hodgepodge of rules governs its distribution.

In Santa Cruz County, zoning regulations do not permit marijuana distributors. Despite that, a handful of retailers operate in the Santa Cruz Mountains, including Evolution in Felton and Da-Vine Intervention in Ben Lomond, according to the directory Web site www.sanjosecannibisclubs.com.

Whitehill said state law is in his favor, and he maintains that he operates under the guidelines of voter-approved Compassionate Use Act.

Dr. Robert Webb, co-author of “Dying to Get High,” a book that promotes the idea that medical marijuana can be distributed safely and ethically, also said legality shouldn’t be in question.

“We’ve got to stop demonizing the plant,” said Webb, a Scotts Valley resident. “It should be between the patient and physician. There are people that are just so sick, and if smoking a joint helps them feel better, who is anyone to stop it?”

The active compounds in marijuana have proven effective to treat conditions such as nerve pain associated with HIV, muscle spasms associated with multiple sclerosis and other pain-related medical conditions, according to state-funded studies by the Center for Medicinal Cannabis Research.

Whitehill said those findings alone are promising, and it’s a good thing for people to replace opiates, such as Vicodin and Valium, with cannabis.

In addition to providing those in need with medicine, Whitehill said, his dispensary has cleaned up the area around the center, which was known as a drug-dealing site where people openly smoked pot outside a nearby coffee shop.

“Since we moved in, that’s not happening, and the reason is because it’s clean,” he said. “And that, to me, is the meat of the debate.”

its easy to get a medicinal cannabis because cannbis can be used for almost any ailmant. it works better and more consistently then almost any perscription medication including opiates (hydrocodine, vicodine). why are people worrying about a plant that has almost no negative properties to it? u cant overdose on cannbis but u can off of vitamin C.

This does not belong here, we have enough problems with drugs in this neighborhood. Do you know how easy it is to get a medical marijuana card? Anyone can, truly sad........ it is however in the already drugged out, filthy looser building. That pig stye of a coffee shop should be closed down, it is a health hazard, as well as the pot shop!

Look who hangs out there! People who have nothing to do with their lives but "hang out" and get high!

Hey you parents who are so concerned about a legitimate collective in our Boulder Creek? Well, it's here and has been and will always be. The fact that a person such as Marc can have the guts to do what he is doing should be applauded. Parents should be educating their children about compassionate care and what this really means. When you have someone in your family with cancer, glaucoma, difficult birthing, AIDS, you name it - the evidence supports the very fact that cannabis has been used medically for ages. Let's look at JESUS, who probably did all that healing work with cannabis soaked oil... It's what they did, it's what we still do. We will keep fighting the good fight. What we need are intervention programs in our schools so that kids know how to deal with their tweaker parents. Why isn't Concerned Parent talking about donating time in her/his community to help prevent more meth use among our youth? Get with it Concerned Parents !

I'm a mother, and a medical cannabis user with a vaporizor. We voted for this and our medicine s/b easy to access and off the black market. Boulder Creek is full of meth freaks and rednecks who really don't care a whit about whether a collective is in our downtown area. Parents are silly to complain about a storefront that is not obvious, and they take care of security well enough that no kids can enter unless they are with a parent. Parents will visit this place with their young children and also should not be chastized. Marc is not only professional but passionate about compassionate care. I support his effort to bring medicine to the community and his business model is something worth talking about. End the rabble about whether cannabis is a legal and very effective medical treatment (has been for eons). Let's rid ourselves of the mentality that meth and booze is OK, the medications "doctors" dispense is what is killing our society. Let's have a little perspective and discuss the real issues. The Press Banner is certainly not known for being a community, newsworthy piece of paper that comes free in my mailbox, but this story should be followed and our community should get involved instead of empty complaints.

Why are none of you concerned Scott's valley citizens concerned about the drug Alcohol? It has never been cleared for medical treatment but there is a bar within half a mile of a JR high school. Kids can get booze easily, sometimes even at home.

I'm not worried about SV youth getting high from a store they can't even enter.Most kids can enter a liqour store to buy candy or soda... You want to block medical MJ from Scotts Valley, Then ban bars and liqour stores too!

I do understand the medical side of it and I agrees HOWEVER, now we will have more STONED people in BC that have got a card from some crack pot doctor!

While I appreciate the benefits that medical marijuana has for many people, I'm not sure that I want this in town.

Also, many users seem to find it a joke that they can complain to their doctor about back pain and get a subscription.

What's the answer? More regulation? Keep it off the main street? I don't know, just not sure how I feel about this yet.

I am glad to Know that BC Guy is in the Minority. This is not the kinda town that will close down a shop like this...This Is Boulder Creek..A liberal town in a very liberal county. These kids hanging out in front of Round Table in town aren't getting there smoke through a collective. This I can assure you..If anything it is making it more difficult for people on the streets to find because more and more is being distributed through legal means. Kids are getting high off their parents medicine cabinets these days anyway..

I wonder if this little shop of horrors will encourage other businesses to invest in Boulder Creek. Because munchies are a side effect of marijuana use, perhaps some new restaurants or cafes might open to cater to clients/patients/patrons/users from the Boulder Creek Collective. Heck, maybe they can copy the Redwood Keg and barbecue tri-tip out front. I think that would be splendid.
